1. Scope of application
Your orders are carried out according to our currently valid General Terms and Conditions. By submitting your contract declaration you accept these. You will find our general terms and conditions on our homepage under the menu item "Terms & Conditions" and can also download, save or print them out directly by clicking on the button "Print this page". After placing your order, you will also receive an e-mail with a link to our general terms and conditions together with the order confirmation.
Please note that contracts with us are concluded in German and that the following terms and conditions also apply to foreign business.
2. Conclusion of contract
Our offers are non-binding and subject to confirmation. This means that the presentation of the products in our online shop does not constitute a legally binding offer.
You can add the products to your shopping cart without obligation at first and always have the opportunity to correct your entries during the ordering process. After checking your details, you finally submit a binding offer to conclude a purchase contract for the desired products by clicking on the "Order with an obligation to pay" button and subsequently receive a confirmation of receipt of your order by e-mail. However, this confirmation does not constitute an acceptance of the offer.
We are entitled to accept orders even partially or to reject them without giving reasons.
3. Registration on our website & Website access
You have the possibility to order from us either as a guest (without creating a customer account) or to create a customer account. In both cases you must be at least 14 years old and have limited legal capacity. By sending the form you confirm the correctness of your details, in particular your name, your age, your legal capacity and your residential address.
If you register a customer account, you are responsible for keeping your access data, especially your self-chosen password, secret. We can only check whether an access code corresponds to a properly activated customer authorisation. We are not subject to any further verification obligation. Any person who logs in with a customer authorisation released on the website and the corresponding access code is deemed to be authorised to place legally valid orders for the customer registered with it. We therefore recommend that you change your password regularly.
We are not liable for uninterrupted functioning of the website. We are entitled at any time, even without prior notice, to carry out work on the website that may result in a shutdown or interruption. We are also not obliged to provide a specific server capacity. Therefore, under certain circumstances, overloads and longer response times may occur.
4. Contract text storage
The contract is concluded in German. The text of the contract is stored by us and for security reasons is no longer accessible via the Internet. However, after placing your order we will send you the order data and a link to our respective valid general terms and conditions by e-mail.
5. Prices & Terms of delivery
All prices in our webshop are stated in Euro and include VAT and exclude shipping costs.
If you have selected "Shipping" in the order process, shipping costs will be added to the product prices shown. Within Austria these are EUR 3.90 and to Germany EUR 9.90. From EUR 50.00 we ship your orders free of charge within Austria and from EUR 150.00 to Germany. Unfortunately, we cannot currently offer shipping to other countries.
We ship exclusively carbon neutrally with the Austrian Post.
If you have selected "Pick up" in the order process, you can collect your order - after receiving a collection confirmation by email - from the respective collection partner Dornbacher Grätzl-Greißler, Dornbacher Straße 101, 1170 Vienna or Wald & Wiese, Kaiserstraße 33, 1070 Vienna during business hours. There are no additional costs for you.
6. Payment methods
In our shop we offer you a choice of several payment options:
- Pay by bank wire transfer: When paying in advance, you first transfer the amount due to our account at the Erste Bank (IBAN: AT31 2011 1838 8931 4900, BIC: GIBAATWWXXX). After we successfully received your payment your order will be shipped or made available for collection.
- Pay now by Klarna: To use 'Pay now' you need a bank account which is activated for online banking. Immediately after placing your order you will be forwarded to the website of Sofort GmbH where you can confirm the payment by entering your data.
- Pay later by Klarna: The purchase on account is handled by Klarna Bank AB (Sveavägen 46, 111 34 Stockholm, Sweden). We will send the goods or make them available for collection and you'll have 30 days to pay directly to Klarna. You can find more information about 'Pay later' on Klarna's website.
- Credit card: When you place your order, you enter your credit card details, which are automatically checked for authorisation by the credit card company. After a successful legitimation the payment transaction will be initiated and your credit card will be charged.
- PayPal: During the order process you will be redirected to the PayPal website where you can confirm the payment by entering your payment details. For this purpose, it is necessary that you register with PayPal or are already registered. After submitting your order, we will request PayPal to initiate the payment transaction, which will then be carried out automatically.
7. Reservation of title
The goods delivered by us remain our property until full payment has been made. You are obliged to treat the goods with care during the existence of this reservation of title. If you are in default of payment, we have the right to withdraw from the purchase contract. In this case, we can demand the return of the unpaid goods.
8. Transport damage
If you notice any obvious transport damage when your order is delivered, please complain to the delivery person and contact us as soon as possible. This will help us to settle our own claims against the transport service provider.
However, should you fail to report such damage this will not limit your legal warranty rights.
9. Warranty
In the event of defects, the statutory warranty provisions apply. However, in the case of damage due to improper use or treatment of the product, there is no warranty claim. The same applies to normal wear and tear.
We make every effort to present the colours and properties of our products on our website as accurately as possible. Nevertheless, how colours are shown depends very much on your particular device. Therefore, the appearance of the delivered product may differ from the appearance on your screen. The goods are deemed to be in accordance with the contract if the delivered goods meet the product specifications stated on our website.
If, after reporting a defect, we ask you to return the goods to us and the defect actually exists, we will also bear the corresponding costs of the return shipment. Otherwise we cannot bear such costs. We therefore ask you to always contact us in advance and only return the goods to us at our express request.

10. Liability
We are liable for damages according to the statutory provisions. However, liability for damage caused by slight negligence is excluded. This limitation of liability does not apply to damages resulting from injury to life, body or health of persons and for claims under the Product Liability Act.
11. Dispute resolution
The European Commission gives consumers the opportunity to resolve online disputes pursuant to Art. 14 Para. 1 of the ODR on one of their platforms. The platform http://ec.europa.eu/odr/ serves as a site where consumers can try to reach out-of-court settlements of disputes arising from online purchases and contracts for services. We declare that we are neither obligated nor willing to participate in online despute resolution.
